1. Agreement to Terms
By accessing or using Metakit, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use the service. These terms apply to all users, including free and paid subscribers.
2. Service Description
Metakit provides automated Open Graph image generation, metadata analysis, and content crawling services. We operate as a subscription-based SaaS platform. You own your content and metadata; we own the infrastructure, code, and generated outputs until delivered to you.
3. Account Registration
You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials and API keys. You must notify us immediately of any unauthorized access. You must be at least 18 years old or have parental consent to use Metakit.
4. Acceptable Use
You agree to use Metakit only for lawful purposes. You may not: (a) violate any laws or regulations; (b) infringe on intellectual property rights; (c) transmit malware or harmful code; (d) attempt to gain unauthorized access to our systems; (e) abuse rate limits or circumvent technical restrictions; (f) scrape or crawl sites without permission; (g) resell or redistribute the service without authorization.
5. Subscription and Billing
Paid subscriptions are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for all fees. Subscriptions automatically renew unless cancelled before the renewal date. We may change pricing with 30 days notice. No refunds are provided for partial months, but you retain access through the end of your billing period after cancellation.
6. Intellectual Property
Metakit retains all rights to the platform, code, and technology. You retain all rights to your content and metadata. Generated images become your property upon creation. You grant us a limited license to process your content solely to provide the service. We may use anonymized, aggregated data for analytics and improvements.
7. Service Availability
We provide the service "as is" and "as available" without warranties of any kind. While we monitor uptime and performance 24/7, we do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications at any time. We are not liable for service interruptions, data loss, or performance issues.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, METAKIT'S TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID IN THE 12 MONTHS BEFORE THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION. Some jurisdictions do not allow these limitations, so they may not apply to you.
9. Indemnification
You agree to indemnify and hold Metakit harmless from any claims, damages, losses, or expenses (including legal fees) arising from: (a) your use of the service; (b) your violation of these terms; (c) your violation of any third-party rights; (d) content you submit or generate.
10. Termination
You may cancel your subscription at any time. We may suspend or terminate your account for: (a) violation of these terms; (b) non-payment; (c) fraudulent or abusive behavior; (d) legal requirements. We will provide notice when possible, but may terminate immediately for serious violations. Upon termination, your access ends and we may delete your data per our retention policy.
11. Changes to Terms
We may update these terms at any time. Material changes will be announced with at least 30 days notice via email or dashboard notification. Continued use after changes take effect constitutes acceptance. If you disagree with changes, you must cancel your subscription.
12. Governing Law and Disputes
These terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles. Any disputes will be resolved through binding arbitration in [Your Jurisdiction], except you may bring claims in small claims court. You waive any right to a jury trial or class action.
